CardioCare Clinic Liability Policy
Introduction
This Liability Policy outlines the responsibilities and limitations of liability for CardioCare Clinic, its employees, contractors, and agents (collectively referred to as “the Business”) in providing Exercise Physiology services.
Scope of Services
CardioCare Clinic provides Exercise Physiology services. These services include, but are not limited to, exercise assessments, personalised exercise programming and prescription (in clinic and home exercise programs), reformer pilates, group exercise physiology, and cardiac rehabilitation.
Liability Limitation
The Business will take all reasonable steps to ensure the safety and effectiveness of the Exercise Physiology services provided. However, by participating in our services, clients, guests, and participating family members acknowledge and agree to the following:
General Disclaimer
To the extent permitted by law, the Business and its representatives are not liable for any injuries, illness, complications, adverse events, or death that may occur as a result of engaging in any exercise programs or exercise physiology services offered, including but not limited to inherent risks associated with physical activity, unexpected malfunctioning of equipment, or slipping or falling within the building or surrounding premises.
Clients acknowledge that participation in exercise and physical activity carries inherent risks, even when conducted under professional supervision.
Clients are encouraged to consult with their primary healthcare provider before commencing any exercise regimen.
Australian Consumer Law
Nothing in this Liability Policy is intended to exclude, restrict, or modify any rights, remedies, or guarantees that cannot be excluded under the Australian Consumer Law or other applicable legislation.
Pre-Existing Conditions
Clients must disclose all relevant medical history, including any pre-existing cardiac conditions, prior to commencing any exercise program.
CardioCare Clinic reserves the right to request health summaries, medication lists, medical clearance, and other medical forms or investigations deemed necessary to support safe and appropriate care.
The Business is not liable for any adverse effects or complications arising from undisclosed conditions, inaccurate information provided by the client, or failure to follow medical advice.
Personal Responsibility
Clients are responsible for following all instructions provided by the Business and must immediately communicate any symptoms, concerns, changes in health status, or discomfort experienced during or following exercise sessions.
The Business is not liable for any injuries or complications resulting from failure to follow instructions, non-compliance with provided guidelines, or failure to promptly report symptoms or concerns.
Indemnification
Clients agree to indemnify and hold harmless the Business, its employees, contractors, and agents from any claims, damages, liabilities, or expenses arising from participation in the Business’s services, except where such claims result from gross negligence or wilful misconduct by the Business.
Emergency Procedures
In the event of a medical emergency, the Business will provide immediate assistance and contact emergency services as required.
The Business is not liable for medical treatment provided on the premises or elsewhere, including decisions, actions, or omissions made by emergency responders or other medical professionals.
Acknowledgment and Agreement
By participating in services provided by CardioCare Clinic, clients acknowledge that they have read, understood, and agreed to the terms of this Liability Policy.
Clients are encouraged to seek independent legal advice if they have any questions or concerns regarding this policy.
Policy Changes
CardioCare Clinic reserves the right to amend this Liability Policy at any time. Clients will be notified of any significant changes, and continued use of services constitutes acceptance of the updated terms.

CardioCare Clinic Cancellation & Refund Policy
Appointments and Cancellations
We recognise that unforeseen circumstances can arise. If you are unable to attend your appointment, please notify us as soon as possible.
Cancellations made within 24 hours of the scheduled appointment time will incur a 50% charge of the consultation fee and loss of pass for group classes.
Failure to attend without prior notification will result in a 100% charge of the consultation fee and loss of pass for group classes.
Exceptions
Exceptions may be considered in extenuating circumstances at the discretion of the clinician. Payment must be settled prior to the next scheduled consultation before Exercise Physiology services can resume. A supporting medical certificate from your GP or specialist may be requested outlining the circumstances preventing attendance.
Clinic-Initiated Changes
If CardioCare Clinic needs to cancel or reschedule an appointment, no cancellation fee will apply and alternative arrangements will be offered.
Class Passes
5-class pass: valid for 6 months from date of purchase
10-class pass: valid for 12 months from date of purchase
Refunds, transfers, extensions, or suspensions of class passes are not offered except in cases of illness, injury, or surgery. In these circumstances, CardioCare Clinic will suspend the class pass until the client is medically cleared to return to exercise.
